Question:

I injured my back in a construction fall at work however I have been informed that I may not be entitled to compensation because of my employment status. Is this true?

Answer:

If you have been injured in a construction fall at work due to somebody else´s negligence, it is still possible to claim construction fall compensation for your injuries. However, the liable party – person or persons against who you make your claim – may not always be the builder for whom you were working if you were self-employed, sub-contracted or supplied by an agency at the time of your accident.

To make a successful claim for construction fall compensation, there are a number of procedures which have to be followed and, of course, it has to be established that you sustained an injury due to somebody´s lack of care. This may be complicated when third parties are involved or if parties make counter-claims of contributory negligence (where you contributed to your construction fall injuries by your own actions).

Even if you are fully aware of your employment status it is always best to consult with a when making a construction fall compensation claim to ensure you receive a fair and adequate compensation settlement.
