Question:

Can I claim compensation if my child is injured by an IKEA high chair?

Answer:

In order to make an IKEA high chair injury compensation claim, your child must have been injured due to a design or manufacturing fault in the high chair. A claim for IKEA high chair injury compensation has to show that the company sold the product in contravention of the Sale of Goods and Supply of Services Act 1980, and that your child sustained an injury due to the company´s negligence.

Your IKEA high chair injury claim would be more likely to succeed if the high chair which injured your child was one of the two brands recalled by the company due to acknowledged defects:-

In December 2009, there was an IKEA high chair recall on the “Leopard” brand of high chairs after it was discovered that faulty safety locks had been used in the manufacturing process which could fail and cause a child to fall between the table and seat of the high chair. If the injury to your child was due to the locks failing on this particular make of high chair, you should be able to make an IKEA high chair injury claim on behalf of your child.

In January 2012 a further IKEA high chair recall was announced for the “Antilop” brand of high chairs following the discovery of a faulty safety belt which could open unexpectedly during use. The lack of a secure safety belt meant that the chairs now presented a risk of falling, and if your child has fallen from this brand of IKEA high chair when you believed them to be secured you would be entitled to claim IKEA high chair injury compensation.

Throughout Ireland, many business establishments are known to use the recalled IKEA high chairs due to their price, ease of cleaning and convenient storage. If the injury to your child occurred in a crèche, restaurant or other business establishment which had failed to heed the IKEA high chair recall, the business establishment – rather than IKEA – would become the party liable for your child´s injuries and against whom your IKEA high chair injury compensation claim should be made.

A claim for IKEA high chair injury compensation would initially be processed by the Injuries Board Ireland, but in order to ensure that you receive the maximum amount of IKEA high chair injury compensation it is advisable to discuss your IKEA high chair injury claim with a solicitor as soon as possible.
